  • What's the difference between fault and no-fault divorce?

    Massachusetts recognizes both “fault” and “no-fault” divorces. In each kinds of divorce, you need to establish a specific reason for the breakup when you file your initial divorce papers. The distinction is that in a “fault divorce,” the rationale for the divorce is based on your spouse’s misconduct. You will have to allege and show that your partner did something that led to the divorce. In Massachusetts fault grounds are:

    • adultery
    • impotency
    • desertion for one year before the divorce
    • drug or alcohol abuse
    • cruel or abusive treatment, or cruel refusal to provide support to the other spouse

    In a “no-fault” divorce, there are not any allegations of distasteful behavior; you'll end your marriage based on “irreconcilable differences,” which is simply a fancy way of saying that you and your spouse don’t get along anymore, and there is no real chance of reconciliation. A no-fault divorce permits you to end your marriage without airing your personal matters in court.
